Agreement Concerning Annual Reports on Human Rights and Free Trade Between Canada and the Republic of Colombia

CANADA and THE REPUBLIC OF COLOMBIA (hereinafter referred to as the “Parties”):

TAKING INTO ACCOUNT that the Free Trade Agreement between Canada and the Republic of Colombia was signed at Lima on 21 November 2008;

AFFIRMING the importance of respect for democracy and human rights;

NOTING the existing national bodies mandated to promote and protect human rights within the respective territories of Canada and Colombia;

HAVE AGREED as follows:

Article 1

Annual Reports on Human Rights

  1. Each Party shall provide a report to its national legislature by May 15 in the year after the entry into force of the Free Trade Agreement between Canada and the Republic of Colombia and annually thereafter. These reports will be on the effect of the measures taken under the Free Trade Agreement between Canada and the Republic of Colombia on human rights in the territories of both Canada and the Republic of Colombia.
  2. Each Party shall make its own reports public.

Article 2

Cooperation Mechanism

  1. The Parties may consult with one another to review the implementation of this Agreement.
  2. The Parties designate the Department of Foreign Affairs and International Trade of Canada and the Ministry of Foreign Affairs of Colombia to implement this Agreement on their behalf.

Article 3

Entry into Force

Each Party shall notify the other Party in writing of the completion of the domestic procedures required for the entry into force of this Agreement. This Agreement shall enter into force on the date of the second of these notifications, or on the date that the Free Trade Agreement between Canada and the Republic of Colombia enters into force, whichever is later.

Article 4

Amendments

The Parties may agree in writing to amend this Agreement. Each Party shall notify the other Party in writing of the completion of its domestic procedures required for the entry into force of the Amendment. The Amendment shall enter into force 60 days from the date of the second of these notifications.

Article 5

Termination

This Agreement shall remain in force unless terminated by either Party with six months notice in writing to the other Party.

IN WITNESS WHEREOF the undersigned, being duly authorised thereto, have signed this Agreement.

DONE in duplicate at Bogotá, this 27 day of May 2010, in the English, French and Spanish languages, each version being equally authentic.
